Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. The deputy commissioner of the division of capital planning and operations is hereby authorized, subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to sell and convey by deed approved as to form by the attorney general, a certain parcel of land located in the town of Salisbury, which has reverted to the commonwealth under the provisions of chapter five hundred and twenty-nine of the acts of nineteen hundred and fifty-seven, to Richard A. DiCarlo, subject to the requirements of section two and to such terms and conditions as the deputy commissioner may prescribe in consultation with the department of public works, said property being described as follows:
A certain parcel of land on the North side line of Beach Road (Route 1A) in Salisbury, Massachusetts being bounded and described as follows:
Beginning at a bound and running:
SOUTHEASTERLY 72<=16'33", twenty-five and forty-one hundredths feet (25.41) from a stone bound, which is also on the North sideline of said Beach Road; thence running
NORTHEASTERLY 17<=43'27", two hundred fifty feet (250.00) by land now or formerly of the town of Salisbury, to a pin to be set; thence running
SOUTHEASTERLY 72<=16'33", one hundred and eighty-eight and forty-four hundredths of a foot (188.44) by land now or formerly of the town of Salisbury, to an iron pin to be set; thence running
SOUTHWESTERLY 36<=33'34", sixty-four and fourteen hundredths of a foot (64.14) by land now or formerly of Richard A. DiCarlo, to a point; thence running
NORTHWESTERLY 69<=11'50", one hundred and twenty-five feet (125.00) by land now or formerly of Richard A. DiCarlo, to a point; thence running
SOUTHWESTERLY 29<=11'17", two hundred feet (200.00) by land now or formerly of Richard A. DiCarlo, to a point; thence running
NORTHEASTERLY 72<=18'35", three and sixteen hundredths of a foot (3.16) along the North sideline of said Beach Road to the point of beginning.
The above description is as shown on a plan entitled "Lot Line Adjustment Plan" at 347 Beach Road, in Salisbury, Massachusetts, at 1 inch = 40 feet, scale prepared by C.D.E.C., Inc., Hampton, New Hampshire, dated _____________, 1988, and to be recorded with said deed upon conveyance.
SECTION 2. Richard A. DiCarlo shall assume the costs of any appraisals, surveys, and other expenses as deemed necessary by the deputy commissioner for the granting of this conveyance.
SECTION 3. Chapter 529 of the acts of 1957 is hereby amended by inserting after the word "taking", in lines 21 and 22, the words:- ; and, provided further, that no portion of said land as described above shall be conveyed or otherwise transferred by the town, to any party other than the commonwealth, without obtaining a release deed to the town executed by the commonwealth in recordable form and authorized by special law, which deed shall release such portion of said land and only such portion from reverter, and thereby conveying any and all right, title, and interest of the commonwealth to said town.
