Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. Notwithstanding the provisions of any general or special law to the contrary, Gus A. Theodore, chief of Palmer Fire District No. 1, is hereby authorized to continue in such position until and including February twenty-eighth, nineteen hundred and ninety-one; provided, however, that he is mentally and physically capable of performing the duties of his office or position; and provided, further, that he shall not serve in such position subsequent to said February twenty-eighth, nineteen hundred and ninety unless and until he shall have been examined, at his own expense, by an impartial physician designated by the Hampden county retirement board to determine such capability. No further deductions shall be made from the regular compensation of said employee under the provisions of chapter thirty-two of the General Laws for service subsequent to February twenty-eighth, nineteen hundred and ninety, and upon retirement said employee shall receive a superannuation allowance equal to that to which he would have been entitled to had he retired on said date.
SECTION 2. The provisions of this act shall take effect as of February twenty-eighth, nineteen hundred and ninety.
