Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. Notwithstanding the provisions of any law to the contrary and in order to promote the public good, the city of Melrose is hereby authorized and directed to retire Wayne R. Ulwick, a member of the police department of said city, who sustained serious and permanent injuries in the performance of his duties, and is totally and permanently incapacitated for further service as a police officer. The annual retirement allowance payable to said Wayne R. Ulwick shall be equal to the salary he would have been entitled to receive had he continued in the service of the police department of said city at the grade held by him at the time of such retirement. Such retirement allowance shall be paid to said Wayne R. Ulwick as of the effective date of this act provided that said allowance shall be in the alternative to, and exclusive of, any other allowance, benefit or other payment to said Wayne R. Ulwick other than that provided in accordance with the provisions of this act.
SECTION 2. Upon the death of Wayne R. Ulwick, the retirement board of the city of Melrose is authorized and directed to pay to Diane Ulwick, his wife, if she survives him and as long as she remains unmarried, an annuity in the amount of three-fourths of the amount payable to him at the time of his death, increased by three hundred and twelve dollars for each child of said Wayne R. Ulwick until such time as each child has attained age eighteen and such payment shall continue for the benefit of each child over the age of eighteen and physically or mentally incapacitated from earning.
SECTION 3. Upon the retirement of Wayne R. Ulwick in accordance with the provisions of section one, the retirement board of the city of Melrose is hereby authorized and directed to pay him forthwith all amounts standing to his credit in the annuity savings fund of the retirement system of said city.
SECTION 4. The retirement board of the city of Melrose is hereby authorized and directed to indemnify said Wayne R. Ulwick for any hospital, medical, and related expenses which may have been or may be incurred as a result of injuries sustained by him in the performance of his duties on September twenty-seventh, nineteen hundred and eighty-six, whether such expenses are incurred before or after the date of such retirement.
