Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. The deputy commissioner of the division of capital planning and operations is hereby authorized, subject to the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to sell and convey by deed approved as to form by the attorney general, a certain parcel of land located in the city of Holyoke, to an individual or entity, subject to the requirements of section two and to such terms and conditions as the deputy commissioner may prescribe in consultation with the department of environmental management said land is bounded and described as follows:-
Westerly by Interstate Ninety-One:
Northerly by land of George W. Page, Jr.;
Easterly by Smith's Ferry Road and the City of Holyoke cemetery
The above description is located within the northerly portion of a plan entitled "Plan of Land in the city of Holyoke, Massachusetts, Hampden County, owned by the Commonwealth of Massachusetts", prepared by Durkee, White, Towne and Chapdelaine, Civil Engineers and Land Surveyors, 356 Front Street, Chicopee, Massachusetts, being Drawing 89-5051, dated June 10, 1990.
SECTION 2. The recipient of said parcel shall assume the costs of any appraisals, surveys and other expenses as deemed necessary by the deputy commissioner for the granting of this conveyance.
SECTION 3. The third paragraph of section 154 of chapter 150 of the acts of 1990 is hereby amended by inserting after the word "date", in line 6, the words:- ; and provided, further, that, in accordance with subsection (5) of section twenty-five of chapter thirty-two of the General Laws, the obligations to the retirees of the Mount Tom state reservation commission which were incurred prior to July first, nineteen hundred and ninety, shall continue to be paid by Hampden and Hampshire counties in proportion to their assessed valuations for as long as such obligations exist.
