AN ACT RELATIVE TO PROBATE JUDGES IN HAMPDEN COUNTY.
Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. Section 2 of chapter 217 of the General Laws, as
appearing in the 1990 Official Edition, is hereby amended by striking out the
first sentence and inserting in place thereof the following sentence:- There
shall be six judges of probate in the county of Middlesex, four judges of
probate in the counties of Norfolk, Suffolk and Plymouth, three judges of
probate in each of the counties of Essex, Worcester, Bristol, and Hampden, and
two judges of probate in the county of
SECTION 2. Section 3C of said chapter 217, as so appearing, is
hereby amended by striking out, in line 1, the word "six", and inserting in
place thereof the word:- five.
SECTION 3. The associate justice affected by the reduction of
justices in section three C of chapter two hundred and seventeen of the
General Laws shall be assigned to the Hampden county division of the probate
and family court department of the trial court and shall be and perform the
duties of a full-time justice in said county or such other county as the
administrative justice may designate. Nothing in this act
shall be construed to establish a new judicial position nor abolish the tenure
of the associate justice so affected.
