Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. The board of selectmen in the town of Falmouth is hereby authorized to adopt regulations to establish one or more parking districts within said town in which parking on public ways shall be restricted to seasonal or year round residents only. Said residents only parking districts shall be established in areas of high population concentration where the proximity of public and private educational or research institutions or transportation facilities make the parking of vehicles by parties other than residents a common occurrence.
SECTION 2. A regulation adopted pursuant to section one may (1) designate one or more districts in which residents only parking shall be in effect, (2) authorize the issuance of permits, stickers, placards or other means of identifying resident vehicles, including an application process for same, (3) set fees for such permits and fines for violations of residents only district parking regulations, (4) include provisions for visitor parking, delivery vehicles, service and repair vehicles and other temporary parking categories, (5) describe signage and other methods of identifying residents only parking districts, (6) designate hours and dates when residents only parking will be in effect, and (7), address such other administrative and enforcement issues as the board of selectmen may deem necessary. Any such regulation may delegate all the powers enumerated above except that contained in clause (1) to designate residents only districts to a board, committee or officer of the town of Falmouth.
SECTION 3. No regulation shall be adopted hereunder until a public hearing is held by the board of selectmen in the town of Falmouth. Notice of such hearing shall be posted in a public place and published in a newspaper of general circulation in said town at least twice in two separate weeks, the first time to be not less than fourteen days before the scheduled date of such hearing.
SECTION 4. For the purposes of this act, a motor vehicle qualifying for resident status permit parking in an area designated as residents only parking by a regulation adopted hereunder shall be registered pursuant to chapter ninety of the General Laws as owned or used by a person residing seasonally or year round in said area. Nothing herein shall be construed to authorize the assignment of a specific space to a person or vehicle, nor shall any such regulation enacted hereunder supersede any general or special law relative to handicapped parking.
SECTION 5. This act shall take effect upon its passage.
