Be it enacted by the Senate and House of Representatives
in General Court assembled, and by the authority of the same,
SECTION 1. The commissioner of the division of capital planning and operations is hereby authorized, notwithstanding the provisions of sections forty E to forty J, inclusive, of chapter seven of the General Laws, to sell and convey by a deed approved as to form by the attorney general, a certain parcel of land presently under the care and control of the department of mental health, situated in the city of Springfield to Western New England College, at fair market value after appraisal and subject to the requirements of section two of this act, and to such other terms and conditions as said commissioner may prescribe. Said parcel is shown on a plan entitled "A Map of Lands Owned By the Commonwealth of Massachusetts in the City of Springfield, Massachusetts. Scale 1"=100' June 25, 1981 R.C. Moore, P.E.", and bounded and described as follows:
Westerly by Evergreen Road, 1,555.67 feet;
Northerly by land of Western New England College as shown on said plan, 878.69 feet;
Westerly by last named land, 502.48 feet;
Northerly by land now formerly of the City of Springfield as shown on said plan, 549 feet;
Easterly by Ashland Avenue, 1,180.41 feet;
Northerly by land of owner unknown, 24.75 feet;
Easterly by land of owner unknown, 1,013.16 feet;
Southerly by land now or formerly of the Commonwealth of Massachusetts as shown on said plan, a total distance of 1,262.25 feet;
Easterly by last named land, 275 feet; and
Southerly by land of owners unknown, 225 feet.
Being part of the premises described in Land Court Certificate of Title #13908.
SECTION 2. The recipient of said conveyance shall assume the costs of any appraisals, surveys, and other expenses as deemed necessary by the commissioner of the division of capital planning and operations for the sale of this parcel.
