Mahoney to provide a safe workplace for employees of the Commonwealth, its independent authorities and other political subdivisions.  [COMMITTEE].  ","DocumentText":"\tSECTION 1. Chapter 149 of the General Laws is hereby amended inserting a new section 40 as follows:\r\n\ta) Notwithstanding any general or special law to the contrary, the division of \r\n\toccupational safety shall apply federal occupational and health standards applicable to\r\n\t private sector employees to employees of the Commonwealth, its independent authorities\r\n\t and other political subdivisions.  Such standards shall include all statutory and regulatory \r\n\trequirements enforced by the occupational safety and health administration with respect \r\n\tto private sector employees, including, without limiting the generality of the foregoing, \r\n\tthe general duty clause. Nothing herein shall affect any state standard that exceeds the \r\n\tstandards applied by the occupational health and safety administration.\r\n\t(b) The division shall have authority to conduct investigations.  The commissioner shall \r\n\thave authority to issue subpoenas and subpoenas duces tecum to compel the attendance \r\n\tof witnesses and/or the production of documents. \r\n\t(c) The commissioner of the division may promulgate regulations and may issue \r\n\tcorrective orders where he has found a violation of this section or regulations \r\n\tpromulgated hereunder.  Proceedings concerning the issuance of regulations or corrective \r\n\torders to public officials shall be adjudicatory proceedings pursuant to chapter 30A and \r\n\tshall be subject to judicial review accordingly.\r\n\t(d) With respect to the exercise of its responsibilities under this section, the division shall \r\n\tbe within the department of labor but not subject to its direction and control.\r\n\t(e) The effective date of this section with respect to cities and towns shall be subject to \r\n\tthe provisions of section 27C of chapter 29 of the General Laws. \r\n\t(f) The provisions of this act shall not apply to the fire services of the Commonwealth, \r\n\tits independent authorities or other political subdivisions. \r\n","EmergencyPreamble":null,"RollCalls":[],"Attachments":[],"CommitteeRecommendations":[{"Action":"Accompanied","FiscalAmounts":[],"Committee":{"CommitteeCode":"J43","GeneralCourtNumber":187,"Details":"https://malegislature.gov/api/GeneralCourts/187/Committees/J43"},"Votes":[]}],"Amendments":[]}
