Notwithstanding any general or special law to the contrary, the Massachusetts Development Finance Agency shall declare surplus and dispose of all roll-on/roll-off cargo handling equipment, ramps, loading systems, transfer structures, and associated appurtenances owned by the agency and located at the New Bedford State Pier as of the effective date of this act.\r\n\r\nMassDevelopment shall, within 180 days of the effective date of this act, undertake all actions necessary to sell, transfer, or otherwise dispose of such equipment at not less than fair market value as determined by an independent appraisal performed by a qualified third-party appraiser retained by the agency; provided, however, that MassDevelopment may convey the equipment for consideration below independently appraised fair market value upon making written findings that the anticipated economic, workforce, maritime, environmental, clean energy, or other public benefits associated with the proposed disposition reasonably justify consideration below independently appraised fair market value.\r\n\r\nIn disposing of such equipment, MassDevelopment shall provide a first priority opportunity to purchase the equipment to a maritime user operating within the Designated Port Area of New Bedford and intending to utilize the equipment for maritime commerce, cargo handling, vessel operations, offshore wind and other clean energy activities, marine transportation, or other water-dependent industrial purposes within the city of New Bedford. If more than one qualified maritime user seeks to acquire the equipment, MassDevelopment shall dispose of the equipment to the qualified maritime user offering the most significant potential to benefit an environmental justice population as defined by M.G.L. c. 30, § 62 and the city of New Bedford, with particular consideration for available developable area to support new growth, and recent and planned future private investment by the bidder.\r\n\r\nIf no qualified maritime user operating within the Designated Port Area of New Bedford submits an offer acceptable to MassDevelopment pursuant to this section within 90 days following public notice of availability, MassDevelopment shall dispose of the equipment to the highest responsible bidder with no consideration given to disposition below independently appraised fair market value.\r\n\r\nThe agency shall not further condition the disposition requirements established by this section except as necessary to complete the sale or transfer authorized herein. All net proceeds derived from the disposition authorized by this section shall be used by the agenda to support the repair and rehabilitation of the New Bedford State Pier. Not later than 30 days following completion of the disposition, MassDevelopment shall submit a report to the clerks of the senate and house of representatives, and the house and senate committees on ways and means, identifying the purchaser, appraised value, sale price, intended use of the equipment, and expected public benefit of the sale.\r\n\r\n\r\n"}
