(a) Notwithstanding the definition of ‘consumer’ in section 1 and the exemptions in paragraph (14) of subsection (c) of section 3, any person that uses an automated decision-making system to make, or be a substantial factor in making, a decision that produces legal or similarly significant effects, as defined in section 1, concerning an individual in the context of that individual’s employment or application for employment, including, but not limited to, decisions regarding hiring, termination, discipline, promotion, compensation, work scheduling or performance evaluation, shall:\r\n\r\n(1) provide the affected individual with clear and conspicuous notice, prior to or at the time of such decision, that an automated decision-making system was used to make, or was a substantial factor in making, such decision;\r\n\r\n(2) provide the affected individual, upon request, with a meaningful explanation of the principal factors and logic used by such automated decision-making system in reaching such decision; provided, that such explanation shall not require the disclosure of a trade secret, as defined in section 42 of chapter 93; and\r\n\r\n(3) provide the affected individual with a timely opportunity to contest such decision and obtain meaningful review by a qualified human decision-maker who has the authority to modify or override the decision of the automated decision-making system.\r\n\r\n(b) Notwithstanding paragraph (2) of subsection (a) of section 14, the attorney general shall have exclusive authority to enforce this section.\r\n\r\n(c) The attorney general may promulgate rules or regulations to implement this section, including, but not limited to, rules or regulations defining the form, content and timing of notices and explanations required by this section.\"\r\n"}
