Kilcoyne","Type":1,"Details":"https://malegislature.gov/api/GeneralCourts/194/LegislativeMembers/M_K1","ResponseDate":"2026-06-03T16:46:43.27"},"Category":null,"Action":"Consolidated","RollCall":[],"Title":"Protected Health Information for HIPAA Regulated Entities","Branch":"House","RedraftNumber":null,"IsFurther":false,"GeneralCourtNumber":194,"Text":"Ms. Kilcoyne of Clinton moves to amend the bill in section 1, in line 88, by striking after the word “seq.” the following:- \", as amended from time to time”\r\nand inserting in place thereof:\r\n“and subtitle D of Title XIII of Division A of the American Recovery and Reinvestment Act of 2009, and the regulations promulgated thereunder by the United States Department of Health and Human Services” and further amend said section, in line 259, by striking after the word “HIPAA” the following:-“, as in effect on the effective date of this chapter”\r\n, and to amend the bill, in said section 1 by striking clauses (7) and (8) of paragraph (a) of Section 3, lines 247-253 and replace it with the following three clauses:-\r\n(7) a nonprofit organization that establishes or maintains a blood bank or transfusion service pursuant to section 184B of chapter 111 and in compliance with applicable requirements of the U.S. Food and Drug Administration, including, but not limited to, 21 C.F.R. parts 600, 601, 606, 607, 610, 630 and 640, as amended, and any successor provisions;\r\n(8) an agent, broker-dealer, investment adviser or investment adviser representative, as defined in section 401 of chapter 110A, who is regulated by the secretary of the commonwealth or the United States Securities and Exchange Commission; or\r\n(9) or protected health information that is collected, created or processed by a covered entity or business associate governed by the privacy, security, and breach notification rules issued by the United States Department of Health and Human Services, Parts 160 and 164 of Title 45 of the Code of Federal Regulations and established pursuant to the HIPAA statute and rules and regulations promulgated under HIPAA.\r\n\r\n, and to amend the bill in said SECTION 1, in line 257, by adding after the word “collects” the following:-“, creates”\r\n"}
