Chapter 10 of the General Laws is hereby amended by striking out section 35PP, as appearing in the 2024 Official Edition, and inserting in place thereof the following section:-\r\n\tSection 35PP. (a) There shall be a Salisbury Beach Preservation Trust Fund which shall be administered by the department of conservation and recreation for the long-term preservation and maintenance of the Salisbury beach and dune system.\r\n(b) The fund shall be credited with: (i) surcharges authorized by subsection (e); (ii) revenue from appropriations or other money authorized by the general court and specifically designated to be credited to the fund; (iii) funds from public or private sources, including gifts, grants, donations, rebates and settlements received by the commonwealth that are specifically designated to be credited to the fund; and (iv) interest earned on any money in the fund.\r\n(c) Amounts credited to the fund shall be expended without further appropriation for: (i) the acquisition of sand for the restoration and stabilization of Salisbury beach and the public areas of the protective dune system abutting Salisbury beach; (ii) the acquisition, installation and maintenance of dune stabilization plants and sand fencing; and (iii) funding beach nourishment and dune stabilization and restoration projects, in whole or in part, or providing local or state matching funds for coastal resilience projects by other governmental or nongovernmental entities.\r\n(d) The unexpended balance in the fund at the close of a fiscal year shall remain available for expenditure in subsequent fiscal years. No expenditure made from the fund shall cause the fund to be in deficit at any point.\r\n\t(e) Notwithstanding any general or special law to the contrary, the department of conservation and recreation shall impose a surcharge of $4 upon each fee charged and collected from admission into, for camping and for parking in the Salisbury beach reservation. The additional money collected from the surcharge shall be deposited into the fund.\r\n\t(f) Annually, not later than March 1, the department of conservation and recreation shall report on the activities of the fund for the preceding calendar year which shall include, but not limited to: (i) a summary of projects undertaken, expenditures made and income received by the fund; (ii) a list of detailed, itemized summaries of executed projects; and (iii) visitor traffic data. The report shall be submitted to the clerks of the senate and house of representatives and to the senate and house committees on ways and means.\r\n\t(g) The department of conservation and recreation shall, biennially, update the Salisbury beach state reservation barrier beach management plan which shall include a long-term disaster prevention and recovery plan and an operational plan for the day-to-day management and maintenance of the beach.”.\r\n"}
