Said section 40 of said chapter 131, as so appearing, is hereby further\r\n\tamended by striking out the third paragraph and inserting in place thereof the following 2\r\n\tparagraphs:-\r\n\tWithin 21 days of the receipt by a conservation commission of a written request made by\r\n\tany person by a method of delivery as specified in regulations, said commission shall make a\r\n\twritten determination as to whether this section is applicable to any land or work thereon. When\r\n\tsuch person is other than the owner, notice of any such determination shall also be sent to the\r\n\towner. As specified by the department in regulations and notwithstanding any local wetlands bylaw or ordinance to the contrary, certain activities may, upon request of the applicant, be approved by\r\n\tdeterminations with conditions, and without the filing of a notice of intention if the conditions\r\n\tensure that the activities will have negligible or minor wetlands impacts. Temporary impacts\r\n\tmay also be approved with a determination with conditions, provided that the wetlands are fully\r\n\trestored as specified by the department in regulations. Violation of a condition of a\r\n\tdetermination of applicability shall be a violation of this section.\r\n\tNotwithstanding any local wetlands bylaw or ordinance to the contrary The department may designate by regulation types of proposed work that have\r\n\tinsignificant wetlands impacts and may, upon the request of the applicant, be approved by the conservation agent or conservation\r\n\tcommission chairman or by the department in writing and without a notice of intention or\r\n\tdetermination and without a public hearing. Such approval may include, but not be limited to,\r\n\tany conditions necessary to further the interests of this section. A copy of the approval shall be\r\n\r\n\r\nsent to the department at the same time it is sent to the applicant, and the department shall have 7\r\ndays from receipt to revoke the approval.\r\n\r\n"}
