Notwithstanding any general or special law to the contrary, the Massachusetts Development Finance Agency shall declare surplus and dispose of roll-on/roll-off cargo handling equipment and associated appurtenances owned by the agency and located at the New Bedford State Pier as of the effective date of this act.\r\n\r\nMassDevelopment shall undertake all actions necessary to sell, transfer, or otherwise dispose of such equipment on or before December 31, 2026 to a maritime user operating within the Designated Port Area of New Bedford and engaged in maritime commerce, marine transportation, cargo handling or offshore wind activities. MassDevelopment shall convey the equipment for consideration below independently appraised fair market value to advance economic, workforce, maritime, environmental, clean energy and other public benefits. If more than one qualified maritime user seeks to acquire the equipment, MassDevelopment shall prioritize the disposition of the equipment to the qualified maritime user offering the most significant potential to benefit an environmental justice population as defined by M.G.L. chapter 30, section 62 and the city of New Bedford, with particular consideration of available developable area to support new growth, and past and planned future private investment by the bidder in the area benefitted by the equipment. The agency shall not further condition the disposition requirements established by this paragraph except as necessary to complete the sale or transfer authorized herein.\r\n\r\nIf no qualified maritime user operating within the Designated Port Area of New Bedford submits an offer to purchase pursuant to this section within 60 days following public notice of availability, MassDevelopment may dispose of the equipment to the highest responsible bidder for the independently appraised fair market value and any additional conditions that the agency deems appropriate.\r\n\r\nAll net proceeds derived from the disposition authorized by this section shall be used by the agency for the repair and rehabilitation of the New Bedford State Pier. Not later than 30 days following completion of the disposition, MassDevelopment shall submit a report to the clerks of the senate and house of representatives, and the house and senate committees on ways and means, identifying the purchaser, appraised value, sale price, intended use of the equipment, and expected public benefit of the sale.\r\n"}
