Notwithstanding any general or special law to the contrary, funds made available through the Community Septic Management Program administered by the Massachusetts Clean Water Trust and the department of environmental protection may be used to finance the repair, replacement, upgrade, design, installation, operation, monitoring or maintenance of innovative and alternative onsite wastewater treatment systems approved by the department pursuant to Title 5 of the State Environmental Code, 310 CMR 15.000.\r\n\r\nEligible projects may include the replacement of existing septic systems with innovative and alternative technologies designed to reduce nitrogen or other nutrient loading to groundwater, surface waters, embayments, estuaries, coastal waters or public water supplies, regardless of whether the existing system has been determined to have failed under Title 5.\r\n\r\nThe department and the Massachusetts Clean Water Trust may promulgate guidance and establish eligibility criteria to implement this section.\"\r\n"}
