Chapter 231 of the General Laws is hereby amended by inserting after section 85AA the following section:-\r\nSection 85BB. (a) In all actions to recover damages for injury to the person or for the death of a person arising from an accident or collision between a vulnerable user, as defined in section 1 of chapter 90, and a motor vehicle, trailer, semi-trailer or semi-trailer unit classified as a class 3 or above by the federal highway administration, with a gross vehicle weight rating of 10,001 pounds or more, there shall be a rebuttable presumption that a defendant who owned or leased the vehicle was negligent, unless, at the time of the accident or collision, the vehicle was equipped with a lateral protective device, convex mirrors, crossover mirrors and backup cameras meeting any standards or specifications adopted by the Massachusetts Department of Transportation.\r\n(b) This section shall be applied and interpreted so as not to conflict with federal statutes, regulations or agency determinations. In any case of conflict, federal law shall prevail.\r\n(c) If any provision of this section is found to be unconstitutional or preempted by federal law, the remaining provisions shall remain in effect to the fullest extent consistent with federal law.”\r\n"}
