AN ACT AUTHORIZING THE TOWN OF GROVELAND TO PROVIDE FOR THE CONSTRUCTION AND MAINTENANCE OF A SOLAR GENERATING FACILITY ON LAND HELD FOR WATER SUPPLY PURPOSES.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. Notwithstanding any general or special law to the contrary, the town of Groveland, in consultation with the board of water commissioners, may authorize a change of use of all or a portion of a parcel of land recorded in the Essex southern district registry of deeds in book 5217, page 779, and as shown on map 24, lot 41 on the Groveland assessors’ maps from water supply purposes to water supply and protection purposes and to provide for the construction and maintenance of a solar generating facility to generate electricity for distribution by the Groveland Municipal Light Department.

SECTION 2. Subject to subsections (a), (b), (g) and (i) of section 16 of chapter 30B of the General Laws and for the purposes of section 1, the board of selectmen, in consultation with the Groveland Municipal Light Department, may enter into a lease, license or other disposition of the property upon such terms and conditions as the board of selectmen and the board of water commissioners shall deem appropriate. The lease, license or other disposition may provide that the Groveland Municipal Light Department shall compensate the town of Groveland for the use of the property for the purposes described in said section 1.

SECTION 3. In consideration for the lease, license or other disposition of the property pursuant to sections 1 and 2, the town of Groveland shall transfer the care, custody, management and control of the town forest property located on Wood street and abutting the town line with West Newbury and consisting of approximately 28 acres, not including approximately 5 acres to be used for a new water tank facility and access road, from the board of selectmen to the conservation commission and such parcel shall be used for conservation purposes.

SECTION 4. This act shall take effect upon its passage.
