AN ACT RESTRICTING THE ABILITY OF THE WATER SUPPLY DISTRICT OF ACTON TO ACQUIRE GROUND WATER SOURCES IN THE TOWN OF BOXBOROUGH.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. Chapter 372 of the acts of 1963 is hereby amended by striking out section 1 and inserting in place thereof the following section:-

Section 1. Notwithstanding chapter 326 of the acts of 1912, no ground water sources in the town of Boxborough shall be used by the Water Supply District of Acton unless the district and the town of Boxborough, acting through its board of selectmen, jointly file a petition with the water resources commission for a finding and, acting pursuant to such petition, the water resources commission finds that there exists in the town sources of ground water adequate for the future needs of the town. If an adequate supply is found within the town, then the water supply district may use the excess for the district. Nothing in this section shall prohibit an agreement by the town and the district to the contrary.

SECTION 2. This act shall take effect upon its passage.
