AN ACT RELATIVE TO THE RETIREMENT BENEFITS OF RETIRED POLICE OFFICER JOHN R. BUSBY, JR. OF THE FALMOUTH POLICE DEPARTMENT.

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows: 
     SECTION 1.  Notwithstanding section 7 of chapter 32 of the General Laws or any other general or special law to the contrary, the Falmouth retirement board shall increase the accidental disability retirement allowance paid to John R. Busby, Jr. pursuant to said chapter 32 to an amount equal to 80 per cent of the current annual rate of regular compensation of a police officer with the town of Falmouth at the same or similar grade held by John R. Busby, Jr. at the time of his retirement.  The current annual rate of regular compensation shall be determined as of the effective date of this act.  The increase pursuant to this section is a 1-time increase which shall establish a new annual retirement allowance for John R. Busby, Jr.; provided, that John R. Busby, Jr. shall continue to receive any current cost-of-living adjustments and any eligible veteran’s allowance to which he is entitled.  
     SECTION 2.  Not later than 30 days after the effective date of this act, John R. Busby, Jr. may elect, pursuant to section 12 of chapter 32 of the General Laws, to accept either: (i) the full annual amount of his retirement allowance in accordance with Option (a) of subdivision (2) of said section 12 of said chapter 32, as established pursuant to section 1; or (ii) a lesser amount, determined by the retirement board with reference to actuarial standards, to provide a retirement allowance to his surviving spouse in accordance with Option (c) of said subdivision (2) of said section 12 of said chapter 32.
     SECTION 3.  This act shall take effect upon its passage.
