This bill amends existing law to make more offenses eligible for juvenile diversion. In addition, this legislation would amend existing law, so a youth would now be eligible for diversion even if they are charged with an offense that carries minimum of greater than five year state prison sentence, if there is concurrent district court jurisdiction for that offense. Notably, this does not mean a juvenile would be diverted, it simply gives a judge discretion to make an assessment based on the seriousness of the case. Further, this bill would limit law enforcement from transmitting a child’s fingerprint-based arrest juvenile records and related juvenile records to the FBI and Department of Justice.
