Under current law, someone receiving public assistance may refuse to establish paternity for a child if they have good cause. This bill specifies that "good cause" includes situations when: the child was conceived as a result of incest or rape; proceedings for the adoption of the child are pending or under consideration; cooperation risks discouraging the noncustodial parent or other relatives of the child from maintaining a relationship with the child or providing emotional or other support; cooperation risks physical or emotional harm to or retaliation against the child or the relative with whom the child resides; or cooperation is otherwise not in the child’s best interest.

Requires the state to pass child support it collects to families, even if those families are receiving public assistance. Under current law, only the first $50 of child support is passed on to families receiving public assistance.

Directs the state, when determining eligibility for public assistance, to disregard child support paid to the family that is below the monthly federal poverty level for the family size.

Requires the state to pass child support it collects to families formerly enrolled in public assistance, including payments on arrears assigned to the state and payments collected through federal tax refund offset.
