This bill is a redrafted approach to the current judicial model for compensation for victims of a wrongful conviction. It retains all the current statutory requirements for imprisonment and overturning of a conviction but creates an administrative claims process in the Attorney General’s Office to process eligible claimants for compensation. Eligible claimants would be able to receive compensation upon release of $15,000, and $115,000 per year of incarceration. The claims process would follow strict deadlines and the claimant could appeal a decision to the Division of Administrative Law Appeals.
