provides that any employee of the Commonwealth considered a court officer or or any state, county or local law enforcement officer shall, upon the direction of a judicial officer, comply with a written detainer request and administrative warrant by the U.S. Immigration and Customs Enforcement requesting detention of an individual on the grounds that there is probable cause that such person is a removable alien for one or more enumerated reasons; requires that such person be provided with a copy of the request provides that no period of detention shall exceed 12 hours; requires that a judicial officer not directing such detention to explain the reasons in writing; adds new section 104 to GL 276 providing that a Judicial Officer presiding over the status of the bail hearing of the individual shall consider the existence of an Immigrations and Customs Enforcement Detainer request from the U.S. Immigrations and Customs Enforcement Office and provides that such a request is grounds for withholding bail.
