Bill Information

Presenter:
John J. Cronin
This bill focuses on the regulation and consumer protection of complex rehabilitation technology wheelchairs, with two main objectives. Firstly, it streamlines the repair process by exempting repairs under $1,000 from preauthorization requirements across various insurance policies and state health programs. This applies to both group and individual insurance plans, including Medicaid, thereby improving accessibility to essential repairs for individuals with disabilities. Secondly, the bill enhances consumer protection measures for wheelchair users by setting out new responsibilities for manufacturers, dealers, and lessors. It requires manufacturers to offer at least a two-year express warranty and ensures consumers are adequately informed of this warranty through clear, accessible communication. If a defect covered by the warranty arises, manufacturers are obligated to provide timely assessments and, when needed, arrange temporary loaner wheelchairs during the repair period. The bill also establishes a mechanism for arbitration and legal recourse for consumers seeking resolutions, with oversight provided by the Office of Consumer Affairs and Business Regulation to ensure adherence to these new regulations and maintain operational integrity.
