An Act relative to traffic regulation using road safety cameras

This bill would create a local to employ automated camera enforcement of certain traffic law violations, including red lights, blocking an intersection, and speeding.

As with a parking ticket, the owner of a vehicle, rather than the operator, would be liable for fines for these violations. Fines would be capped at $150. To remove the incentive to use automated enforcement as a revenue generator, net revenues received by a city or town must be deposited in the Massachusetts Transportation Trust Fund.   

To protect privacy, the bill prohibits pictures of the front of a vehicle. Photographs may only be taken when an enforceable violation occurs. Any photographs taken are not admissible or discoverable without a court order. All photographs must be destroyed within 48 hours of the final disposition of a violation.    

To ensure transparency and accountability, the locations of all cameras must be approved by a vote of the municipality’s legislative body. Each municipality must produce an annual report that includes the locations of each camera and an analysis of the nexus of each location with safety data, which will be published by the Massachusetts Department of Transportation.
