This bill seeks to bring Massachusetts in line with the majority approach by eliminating the requirement that rental car companies provide such primary financial responsibility. The basic premise of the proposed change is to require that an insured at fault party in an accident should be responsible for the damages they cause. Rental car companies would still be financially responsible for their own negligence, that of their employees, and as a guarantor of the Minimum Financial Responsibility limits.
