Consumer Protection

There is a large and unjustified discrepancy between the rights and protections provided to Massachusetts consumers who purchase motor vehicles and those who lease. Massachusetts consumers who purchase motor vehicles have legislative protections including against defective used vehicle (G.L. c. 90, 7N, 7N1/4), fair financing, and unfair repossession practices. in there are Massachusetts laws gives strong legal protections to consumer purchasers of motor vehicles, few of those protections are extended to consumers who lease. Because of this legislative oversight, Massachusetts consumers who lease a vehicle are relatively unprotected under state law compared to those who are able to buy. This is even worse for the growing number of people leasing used motor vehicles. Massachusetts should join the 25 other states, including Connecticut, New Hampshire, New York, Maine and Rhode Island that provide legislative protection to consumer motor vehicle leases. This bill would pose no new obligations on dealers or finance companies other than what currently exists for consumer motor vehicle sales or is required by federal law. If anything, it would simplify regulatory compliance by creating a unified standard for consumer motor vehicle transactions, both purchases or leases.
