Price adjusting

• Prohibits food stores and departments from suggesting items or adjusting the prices of any item in the food store and food department directly or indirectly based on the biometric data (e.g. fingerprint, a voiceprint, eye retinas, irises, or gait) of individuals collected on the premises of a food store and food department.

• Permits food stores and food departments to use biometrics to allow customers to voluntarily verify their identity at the point of sale.

• Establishes that violation of this section constitutes a violation of the consumer protection law, Chapter 93A, and that damages are actual damages or $5,000, whichever is higher.
