This bill requires that, beginning on April 1, 2026, entities participating in the federal 340B drug pricing program in Massachusetts must submit an annual report to the Center for Health Information and Analysis. This report should include comprehensive financial and operational data, such as the aggregate acquisition costs for covered outpatient drugs, insurer payments, and the total number and percentage of prescriptions filled by insurance type. Entities must also disclose total operating costs, highlighting those related to passing 340B discounts to patients, implementing sliding fee scales for low-income individuals, and providing charity care. Additionally, the report must detail payments to contract pharmacies and third parties for 340B services and list the number and locations of contract pharmacies.

The report should also cover prescriptions filled by the entity and any offsite facilities, the proportion processed by contract pharmacies, and related remuneration for 340B services. An officer must certify the accuracy and completeness of these reports, ensuring transparency and accountability. The Center will make these reports publicly accessible on its website. The act, aiming to increase transparency and oversight of the 340B program, takes effect immediately upon passage.
