      Item 4512-0500 contained in section two relative to the Division of Dental Health Administration comes from the House with the endorsement that the House has passed this item notwithstanding the reduction in objections of his excellency the governor, 123 to 32.

      The question before the Senate is, shall this item pass notwithstanding the objections of the governor to the contrary. The senator from Plymouth and Barnstable, Mr. deMacedo.

      Thank you, Madam President. And again I rise before the body to get an explanation in regards to item 4512-0500 titled Dental Health Services. Again, this was a reduction of $150,000. Might the gentlelady from Salem give us an explanation of what this particular override does?

      Thank you, Madam President. This veto would reduce Forsyth dental health program for kids by $150,000. ForsythKids provides preventative dental care to Massachusetts children of all ages in participating schools or eligible locations. These include on-site dental examinations, oral health education, and services such as dental cleaning, application of fluoride, and sealants to prevent decay.

      Oral health condition is closely tied to overall health, can serve as an important indicator. By improving and increasing access to oral health, particularly to vulnerable and underserved populations, we are making strides in improving quality of life and overall being of health of individuals. Therefore I ask that you overturn this veto. Thank you.

      Hello Madam President, welcome to the rostrum. We appreciate your work. I am here to rise to ask a question in regards to, again, line item 4513-1002. Again, this is a reduction of $17,000 out of an $11,869,000 line item. I was wondering what the rationale might be in regards to overriding the governor's veto on this one. Thank you very much.

      Thank you Madam President. The Women, Infants and Children WIC program provides nutrition, education, counseling, and makes health care and social service referrals, distributes checks for healthy foods to low income, moderate income, to low and moderate income pregnant, breastfeeding, and postpartum women as well as infants and children up to the age of five certified as medically or nutritionally at risk. WIC participants also receive coupons redeemable at community farmer's markets for for fresh produce. It's important we include full funding for this program in order to increase access to health services and ensure the well-being of women, infants, and children who are at nutrition risk. Therefore I ask that you overturn this veto. Thank you.

Madam President, I'm hoping we can get an explanation of this particular item. I believe it's 4513-1026, if I'm not mistaken.       Thank you Madam President. This veto would eliminate $50,000 in the suicide prevention account. This funding is for Samaritans Fall River New Bedford that offers a confidential mental health and social support call line that assists individuals and families who are going through crisises and helping those who may be suicidal.

      Although suicide rates are lower in Massachusetts and nationwide, by offering targeted local resources 24 hours a day, seven days a week, we're ensuring that individuals are always able to reach someone. It's essential that we invest in programs that offer lifesaving compassionate services to individuals who have suicidal thoughts. Therefore, I ask that you overturn this veto. Thank you.

      Thank you. Thank you, Madam President, and through you to my colleagues. I rise to ask a question in regards to this, again, item 4513-112, stop stroke program. And again I'm trying to get understanding. It seems to be reduced by $200,000 which eliminates the program.

      However, it seems as though from the FY spending, it was a negative $280,000 last year. I'm hoping that we might get an explanation of this program. Is it a new program? Or is it a existing program that was underfunded? Thank you very much.

      Thank you, Madam President. According to recent data, stroke is the third leading cause of death in Massachusetts. This account funds a public awareness program campaign regarding the signs and symptoms of stroke, expands the stroke registry data platform, and supports a new requirement for all primary stroke service hospitals and emergency medical service agencies to report standardized data to DPH. By investing in a separate program we are increasing education outreach activities.

      Please give the speaker their attention. It's very hard to hear in here. It's not right that someone has to get that close to hear. So if you want to speak, please go out. But we're going to be calling very quickly. So if you miss it, you missed your vote. So yes, continue.

      Thank you, Madam President. By restoring $200,000 to the stop stroke program, the program would help save lives by generating public awareness and increasing the conversation on how to react when someone is suffering from a stroke. Therefore I ask that you overturn this veto. Thank you.

Item 4513-1130 entitled Domestic Violence And Sexual Assault Prevention Treatment. This was reduced by $20,000. It is a $31,355,000 line item. I'm hoping that we might get an explanation why the governor vetoed $20,000. Thank you very much.

      Thank you, and I appreciate the question as to why the governor vetoed the $20,000 and I am simply unable to answer that question. This $20,000 is for a domestic violence program called Delamano Inc. And it services and provides resources for individuals to disassociate them from any conditions of domestic violence. So it helps the individuals leave domestic violence situations, sexual abuse, unhealthy relationships. So we know how critically important these services are so I ask that you overturn his veto.

      Thank you, Madam President, and through to the members. It is my distinct honor and privilege to stand before the Massachusetts State Senate today to do three things. First and foremost, wish a very happy 242nd birthday to the United States Navy, the world's finest navy, and wish them a happy 240--

      Absolutely right. Good crew here, right? All right, outstanding. Secondly, I would like to wish a very happy 220th birthday to the United States-- the USS Constitution, the oldest commissioned warship afloat in the world, nicknamed Old Iron Side in the War of 1812. Not only that gem of the United States Navy but also the city of Boston in our very own Commonwealth of Massachusetts. So happy birthday USS Constitution.

      [APPLAUSE]

      And third and lastly, to introduce the current commanding officer of the USS Constitution and just tell you a little bit about him. And he's going to say a few words about all the great things that have gone on over at Constitution the last three years and introduce some other sailors here as well. But I just want you to know a little bit about the skipper of the boat, because he has just done some incredible things. Commander Robert Gerosa is a native of New Rochelle, New York, but more importantly a graduate of Providence College. All right, there we go.

      Selected to attend Naval Officer Candidate School and was commissioned an ensign in September of 1997. His assignments have included the USS Nassau, where he was the main propulsion division officer and electrical officer. During his tenure, the Nassau deployed to the Mediterranean Sea in support of NATO operations during the Kosovo campaign. In May 2000, Commander Gerosa transfer to the guided missile destroyer, USS Ramage as the combat information center officer and assistance operations officer. Following the September 11th 2001 terrorist attacks, Ramage was the first ship in the Atlantic fleet off the East Coast of the United States to provide extended radar coverage for Washington DC and New York City.

      Remage went on to deploy overseas in support of Operation Noble Eagle and Enduring Freedom. In March of 2003, he was selected as a lieutenant to attend the United States Naval War College in Newport, Rhode Island and graduated where he was awarded a master of science degree in national security and strategic studies. In March of 2005, he reported to the USS Whidbey Island as a first Lieutenant. In the wake of Hurricane Katrina, Whidbey Island became part of the Task Force Katrina and conducted humanitarian and disaster relief assistance in the gulf states.

      In July 2006, he transferred to amphibious squadron two, Bataan expeditionary strike group as the staff operational officer. He also served as the amphibious staff officer for CTF 51/59 at NAVCENT. Commander Gerosa's shore assignments include director of operational support for the Naval War College international program, aide de camp for the director of expeditionary warfare op nav staff, in service amphibious ships resources officer, and expeditionary warfare lead instructor at surface warfare officer school. In August 2015, commander Gerosa assumed command of the USS Constitution, today, as the ship's 74th commanding officer. Please join me in welcoming the skipper to the Massachusetts State Senate.

      For the last-- thank you very much. For the last 21 years, I've tried to fly below the radar. You go to work, you do your job. This job, being a part of something so special not only for the Navy but to the state of Massachusetts and to the nation. You're right in the center of the radar.

      And I'm always humbled and I'm kind of mortified as people are reading my bio and I definitely need to shorten that. So thank you for the warm welcome. I do [INAUDIBLE] commander Nate Schick, who is relieving me. He will be number 75 in command of the USS Constitution, which is again, the cornerstone of our fleet. My XO, Tim Anderson, and Tim's relief-- you got us all at a good time-- commander John Bender, who is just between John and Nate. They're both coming off of out doing the nation's business.

      Over the last three years I've had it pretty good, even as a New Yorker. So me and my family have had the opportunity to be a part of something special, be a part of a state that looks after not just its military people, its military active duty, reserves, guardsmen-- but a state that looks after all of its citizens. This is truly a special place. And I happened to be with the governor Baker last night for a brief minute at a reception and I told him, I said, to be a part of something so special takes a large organization and one that needs to talk.

      I have a ship of 70 people. We don't get along on a daily basis, but at the end of the day we do what's best for the ship, just like what you're doing here today. So I appreciate everything that you do for the state, our military personnel, and our veterans.

      The ship has been in a bit of a rehab period. You know, 220 years, she was time for a little bit of service. So we did take her out of the water. But she is back in, I'm happy to say, after about 26 months in dry dock. Constitution was only supposed to last [INAUDIBLE] service. 220 years, we're still maintaining her. You might ask why that the government is spending-- it wasn't, I would say, a lot of money-- but the government spent money to ensure this ship remains a part of our fleet. It maintains a part of the state.

      [INAUDIBLE], we go out to sea. That's what we do. Most people don't get a chance to step aboard Navy vessels. When people come aboard Constitution, and we see somewhere between a half a million and 600,000 visitors a year, those visitors are not just from Massachusetts. They're from around the world.

      When they step aboard, they are seeing the nation's best and brightest. My sailors, your sailors, come from all corners of the country. They represent every race, every diversity, every religion. They all have one thing in common. They raised their right hand, just like you all do, to support and defend something bigger than themselves. It is selfless service.

      So when people step aboard your ship, it's America's ship of state, they are seeing the best and brightest of America. They are seeing active duty sailors. And though we have a pretty good year, we will all go on to do other things. We have 322,000 sailors in about 275 ships. Out of that more than 100,000 sailors are deployed right now.

      We have 150 ships at sea. We're doing humanitarian operations. We're doing combat operations. We're doing anti-piracy. We like to say, it's kind of like the police.

      We're there when you need them. Well, we're there around the clock, 24 hours a day, seven days a week. So we will be there when we get the call. So again, Constitution, we represent all the people that wear this uniform and serve this great nation. So I would like to say thank you for recognizing us.

      Please come out. Please come down. Senator Rush knows how to get in touch with me and he will know how to get in touch with commander Bender. I'm sorry, commander Shick. I was looking at John. Sorry about that. The two of them.

      At this point, as is tradition with the United States Navy and all military branches, in celebration of the birthday we are going to cut a cake. It was eliminated by the administration. We in the Senate did not include it in our version of the budget. And I'm hoping we might get an explanation of why we believe it should be overridden.       This veto eliminates in totality the health care industry retained revenue accounted $200,000. This is a new retained revenue account that would be used to support the recently revised DPH's determination of need program and health care facility plan review. So it's part of the new process that allows DPH to retain a portion of the existing determination of need application fees to ensure that the applications are reviewed in a comprehensive and timely manner. So I ask that you overturn the veto.

These seven community based services provide families and children with resources, guidance, and support to ensure a happy, healthy, and stable homes.       This veto would also decrease funding for the Children's Advocacy Center of Pursell county, which provides a place for children to [INAUDIBLE] physical abuse to provide the details of their victimization only one time during the investigation. The DHM adult support services account funds community based services for adults, including day programs and case management.       This veto seeks to eliminate an interagency agreement between the Department of Mental Health and Executive Office of Elder Affairs for increased resources for adult home and community based behavioral health services to adults over 60. Other initiatives that are cut by this cut include the William James Interface Referral Service and International Institute of New England which provide humanitarian relief, education, skills, and training. It's crucial we support these initiatives therefor I ask for you to overturn this veto.

      Thank you, Mr. President. This veto would reduce the community residential and vendor operated services in DDS by over $6.8 million. That's will compromise annualized funding for [INAUDIBLE] graduates. There were 900 of the individuals in FY 2017 and a projected number of 975 individuals in FY 2018. Support includes residential placements and other resources needed to help these individuals thrive in their communities. I ask that you overturn this veto.

      Thank you very much, Mr. President, and through you to the assistant vice chair of ways and means, the gentlemen that has just spoken, because I just want to make sure I'm-- I've been paying very close attention to many of the amendments that are overridden. And thinking about the history as to how we got here and the very specific questions that our friends in the minority party are asking, to make sure that we all understand what is taking place. And as I understand it, the amendment before us, and the last couple of amendments that we just adopted the override on, were dealing with developmental disabilities. Were they not?

      Yes, Mr. President. Again, my question to the vice chair is, I just want to make sure this is clear that this is, in fact, the amendment that take services away from the developmentally disabled in the Commonwealth, where we have a waiting list for this particular program. I just want to make sure this is clear to me because as I understand it, the governor vetoed this piece and this is going to take services away from these people. I just want to make sure I'm clear on that.

      Thank you, Mr. President. This cut of almost $7 million is in the DDS community residential and vendor operated services. So these are programs specifically targeted to this line item are for the annualization of people who had turned 22 in this program. You become eligible for DDS when you turn 22. And that's been a big thing that the Senate has tried to end the waiting list of turning 22 so that everybody gets services.

      This when they turn 23, 24, the line items of the subsequent years may increase because there's an increased number, and specifically for this line item, there have been more turning 22 clients, or consumers. This would cut the programs delivered to those who are 23, 24, and go on. Not the actual consumers who are turning 22, but who have already turned 22 and are in need of continued services.

In FY 17 we spent 218 million dollars. And when I looked at the budget in the House and the Senate, we spent only $216 million. My question is, why did we reduce that line item by $2 million in the legislature for community based residential services? Thank you Mr. President.

      Thank you, Mr. President. This veto would eliminate local priority in the DDS respite and family serves account totaling $180,000. The funding would be allocated to the state operator programs account which funds 24 hour residential services provided by state employees. The eliminated funding was allocated to the Tetris House in Cohasset to support maintenance repairs. Therefor I ask that you overturn this veto.

      Thank you, Mr. President. I think there may have been a little bit of confusion. I appreciate the gentleman from Everett's explanation but we have a further question with regard to this item. It appears that the final general appropriations act actually reduced funding for this item by 10 million dollars. And in fact the conference committee report reduced the Senate appropriation by about $2 million. So we're curious as to what's exactly happening here so that we can put the governor's request and the governor's action into clearer context. Thank you, Mr. President.

      Thank you. I just want to gently remind the minority leader that we had an $833 million gap in our budget. So unfortunately a lot of line items were cut. Most of them, you know that, well, is was a very difficult process. But we had to cut 833 million. Therefor every area of the budget saw pain and was touched by the cuts.

      Thank you, Mr. President. I appreciate that helpful reminder and I hope that we don't seem to find another helpful reminder in the form of 9C cuts that indicate we haven't done enough. But I would be very quick to point out that perhaps that's why the last account which increased by $48 million from last year was reduced by the governor, attempted to be reduced by the governor, because of that $833 gap. And it also helps to put into perspective this reduction of $180,000 because it is just possible that the governor was also trying to meet that fiscal reality in a much less severe way than we did in our own budgeting. The senator from Essex and Middlesex, Mr. Tarr, moves that when the Senate adjourned today it do so in memory of Michelle Nowak of Middleton.

      Michelle Nowak of Middleton passed away on September 23rd, 2017 at the age of 54. Michelle Marie Nowak, beloved wife of Mark Nowak, served her community as a reserve police officer with the Boxford and Middleton police departments at the time of her death. Ms. Nowak was born in Salem and grew up in Beverley. She graduated Beverley high school in 1982 and went on to further her education at Salem State College. After graduating college, Ms. Nowak pursued her passion for law enforcement by working in the Essex County Sheriff's Department.

      She took time off from her career to raise two children. After her children had grown, she returned to work as a reserve police officer with the town of Boxford police department in 2005, and later became the town's DARE officer in 2008. With her title of DARE officer she was able to teach children the negative effects of drugs and alcohol, something she found extremely important. She made such a profound impact on her community she was later appointed president of the Massachusetts DARE Association.

      Starting in 2007, Ms. Nowak began working as a reserve officer in the town of Middleton where she lived. Her involvement in both departments allowed her to impact the tri-town community in a memorable way. Ms. Nowak truly enjoyed your career and made a lasting impact on all around her. She took pride in her work and put significant effort into making her town safe for every one of their members.

      Her compassionate personality made her likeable and approachable. She was extremely respectful to her superiors and was fond of every individual she was able to work with over the years. Ms. Nowak put others before herself and strived to make both Boxford and Middleton better communities for all.

      An active member of her community, Ms. Nowak was a member of the recreation commission in the town of Middleton for many years. She was a devoted communicant to Saint Agnes church in Middleton as well. She enjoyed making a difference and playing an important role in her community, and she deeply cherished the bonds she had made over time.

      To Ms. Nowak, family always came first. She will always be remembered as a loving wife, mother, sister, and aunt. She had a love for the outdoors and spent as much time as she could fishing or snowmobiling with her wonderful family. Ms. Nowak spent her life caring for and protecting all those around her, including members of her community that she had never met before.

      She always had a welcoming smile on her face and could light up a room, and a heart so big it cared for everyone lucky enough to know her. Her unforgettable positive attitude, devotion to her career, and her zest for life will never be forgotten. She will be deeply missed and forever remembered.

      She is survived by her husband of 25 years, Mark Nowak of Middleton, her daughter Alice and Mary Nowak of Middleton, her son Christopher George Nowak of Middleton, her sister Marissa Mears of Salem, her brother Kevin O'Brien of Beverley, many loving family members, her fellow officers, and friends.
