Fact Sheet & Highlights: An Act Relative to Toxic-Free Medical Devices S.3106

June 1, 2026

An Act relative to toxic-free medical devices would ban the use of DEHP, a toxic chemical, in intravenous bags and tubing in Massachusetts. Intravenous (IV) bags are supposed to be tools in the fight against disease and illness, but many IV bags currently contain DHEP, which is added to improve flexibility of plastic but can leach into patients.

DEHP—Di(2-ethylhexyl) phthalate—has been linked to breast, liver, lung, and testicular cancer, according to Breast Cancer Prevention Partners.

The details of the legislation are below.

Bans DEHP Use in Certain Medical Equipment

Removes Added Chemical from IVs. Prohibits the manufacture or sale of IV solution containers made with intentionally added DEHP as of January 1, 2030. Likewise prohibits the manufacture or sale of IV tubing products with intentionally added DEHP as of January 1, 2035.
