Fact Sheet & Highlights: An Act Updating the Unit Pricing Exemption Threshold S.2965

An Act updating the unit pricing exemption threshold supports neighborhood markets, bodegas, convenience stores, and family-owned grocery shops by ensuring that an exemption from unit pricing requirements continues to apply as intended to smaller establishments.

Currently, establishments are not required to include a unit price on items if they generate less than $5 million in in-store sales each year, including sales of Lottery products and gift cards. Sales of higher-value Lottery products, such as $50 scratch tickets, the increased popularity of gift cards, and rising prices on other products due to inflation and tariffs have pushed small businesses closer to the threshold.

The bill amends that exemption by removing sales of Lottery products and gift cards from the calculation of whether a store meets the threshold.

Updates Unit Pricing Exemption Threshold. Excludes the sales of lottery tickets and gift cards from counting toward a retail establishment’s annual sales volume, for purposes of applying the unit pricing exemption threshold.
