AN ACT AUTHORIZING THE MASSACHUSETTS DEPARTMENT OF TRANSPORTATION TO ACQUIRE CERTAIN PARCELS OF LAND IN THE TOWN OF HOPKINTON.
Whereas, The deferred operation of this act would tend to defeat its purpose, which is to authorize forthwith the Massachusetts Department of Transportation to acquire certain parcels of land in the town of Hopkinton, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
SECTION 1. (a) The Massachusetts Department of Transportation may acquire by purchase or otherwise, certain parcels of town-owned land in the town of Hopkinton. These parcels shall be diverted from their present use for conservation or open space purposes to a highway use for the department; provided, however, that the diversion of use for parcels 5-TE-1 and 5-TE-2 shall be temporary and for a period not to exceed 5 years.
(b) The descriptions of the above-referenced parcels are as follows: Parcel 5-1-T is a parcel of land located west of Cordaville road (Route 85) and north of Lincoln street in the town of Hopkinton, bounded and described as follows: beginning at a point on the westerly line of Cordaville road (Route 85) about fifty five feet (55’) southwesterly of intersection of Cordaville road with the town line between Hopkinton and Southborough; thence southwesterly and curving to the right along the arc of a curve having a radius of three hundred seventy five and no hundredths feet (375.00’) and length of one hundred-seventy-two and two hundredths feet (172.02’), a chord bearing of S44°27'00"W and a chord distance of one hundred-seventy and fifty two hundredths feet (170.52’) to a point; thence S57°35'29"W a distance of one hundred sixty five and eighty nine hundredths feet (165.89) to a point; thence southwesterly and curving to the left along the arc of a curve having a radius eight hundred thirty three and twelve hundredths feet (833.12’) and a length of eighty-five and twenty four hundredths feet (85.24), a chord bearing of S54°39'37"W and a chord distance of eighty-five and twenty one hundredths feet (85.21) to a point the last three (3) courses by Cordaville road; thence N47°59'04"E a distance of eighty-six and no hundredths feet (86.00’) to a point; thence N55°52'00"E a distance of one hundred sixty six and twenty seven hundredths feet (166.27’) to a point; thence northeasterly and curving to the left along the arc of a curve having a radius of three hundred sixty and no hundredths feet (360.00) and a length of one hundred fifty four and ten hundredths feet (154.10’), a chord bearing of N45°19'43"E and a chord distance of one hundred fifty two and ninety three hundredths feet (152.93’) to a point; thence N85°15'57"E a distance of eighteen and seventy six hundredths feet (18.76’) to the point of beginning, the last four (4) courses by land now or formerly of the town of Hopkinton. This parcel of land contains 4,885 square feet.
Parcel 5-1 is a parcel of land located west of Cordaville road (Route 85) and north of Lincoln street in the town of Hopkinton, bounded and described as follows: beginning at a point on the westerly side of Cordaville road (Route 85) at the intersection of the westerly line of Cordaville road (Route 85) with the town line between Hopkinton and Southborough; thence southwesterly and curving to the right along the arc of the curve having a radius of three hundred seventy five and no hundredths feet (375.00’) and length of fifty four and ninety eight hundredths feet (54.98’) a chord bearing of S27°06'30"W and a chord distance of fifty four and ninety three hundredths feet (54.93’) to a point, the last course by Cordaville road; thence S85°15'57"W a distance of eighteen and seventy six hundredths feet (18.76’) to a point; thence, northeasterly curving to the left along the arc of a curve having a radius of three hundred sixty and no hundredths feet (360.00’) and length of fifty nine and sixty seven hundredths feet (59.67’), a chord bearing N28°19'00"E and chord distance of fifty nine and sixty one hundredths feet (59.61’) to a point, the last two (2) courses by land now of formerly of the town of Hopkinton; thence S82°30'46"E a distance of fifteen and fifty eight hundredths feet (15.58’) to the point of beginning, the last course by the town line between Hopkinton and Southborough. This parcel of land contains 859 square feet.
Parcel 5-TE-1 is a parcel of land located west of Cordaville road (Route 85) in the town of Hopkinton, bounded and described as follows: beginning at a point on the westerly line of Cordaville road (Route 85) about 450’ northeasterly of the intersection with Lincoln street; thence southwesterly and curving to the left along the arc of a curve a distance of about one hundred seventy six feet (176’) to a point, the last course by Cordaville road; thence northeasterly a distance of about one hundred fifty three feet (153’) to a point, the last course by land now or formerly of Andrew and Teresa Boyce; thence northeasterly a distance of about two hundred forty six feet (246’) to a point; thence southeasterly a distance of about thirteen feet (13’) to a point; thence southwesterly a distance of about one hundred twenty eight feet (128’) to a point; thence southwesterly a distance of about eighty six feet (86’) to the point of beginning, the last four (4) courses by land now or formerly of the town of Hopkinton. This parcel of land contains about 6,726 square feet.
Parcel 5-TE-2 is a parcel of land located west of Cordaville road (Route 85) and north of Lincoln street in the town of Hopkinton, bounded and described as follows: beginning at a point on the town line between Hopkinton and Southborough and about 16’ west of the westerly line of Cordaville road; thence southwesterly and curving to the right along the arc of a curve about one hundred sixty two feet (162’) to a point; thence northwesterly a distance of about four feet (4’) to a point; thence northeasterly and curving to the left along the arc of a curve about one hundred and six feet (106’) to a point; thence northeasterly a distance of about forty five feet (45’) to a point; thence southeasterly a distance of about nine feet (9’) to a point; thence easterly a distance of about three feet (3’) to the point of beginning, the last six (6) courses by land now or formerly of the town of Hopkinton. This parcel of land contains about 723 square feet.
SECTION 2. The aforesaid parcels of land are shown on a plan entitled, “Hopkinton-Southborough Route 85 (River St.) Over Sudbury River”, which is on file with the chief engineer of the highway division of the Massachusetts Department of Transportation.
