AN ACT AUTHORIZING THE TOWN OF NEEDHAM TO CONVEY A PARCEL OF LAND AND GRANT AN EASEMENT TO SUPPORT NATURAL GAS TRANSMISSION.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. The board of selectmen and the conservation commission of the town of Needham may convey a certain parcel of conservation land, containing approximately 375 square feet, located at Ridge Hill Reservation, off Mary Chilton road in the town of Needham, to Algonquin Gas Transmission, LLC to correct an encroachment of a building by Algonquin Gas Transmission and to operate and maintain a gas transmission line utility. The parcel is identified as Tract N-215A on a plan prepared by the town of Needham conservation commission and dated May 27, 2011.

SECTION 2. In consideration for the conveyance authorized in section 1, Algonquin Gas shall make a payment in the amount of $50,000 to the Conservation Trust Fund of the town of Needham.

SECTION 3. The town of Needham, acting by and through its conservation commission and board of selectmen may transfer to its board of selectmen the care, custody and control of a certain parcel of land acquired for conservation purposes to be used for general municipal use for the purpose of installing and maintaining a cathodic protection system for a gas transmission line for Algonquin Gas. The parcel contains approximately 18,764 square feet of land, is at Ridge Hill Reservation, located 461 Charles River street and is shown on a plan entitled "Ridge Hill Cathodic Protection System Permitting Plan" prepared in 2010 by Vanasse Hangen Brustlin, Inc., of Watertown, MA.

SECTION 4. The town of Needham, acting by and through its board of selectmen, may grant a cathodic protection easement to Algonquin Gas on 19,564 square feet of land within Ridge Hill Reservation described in section 3 containing 18,764 square feet and another parcel of land containing approximately 800 square feet that is held by the town for municipal purposes. Such easement shall be for the installation and maintenance of the cathodic protection system for a gas transmission line for Algonquin Gas.

SECTION 5. In consideration for the grant of the easement set forth in section 4, Algonquin Gas shall make a payment in the amount of $20,000 to the Conservation Trust Fund of the town of Needham.

SECTION 6. If the lands conveyed and transferred pursuant to sections 1, 3 and 4 cease to be used for the purposes described in said sections, the lands shall revert to the town of Needham and shall be dedicated to conservation purposes within Ridge Hill Reservation.
