AN ACT AUTHORIZING THE CITY OF MALDEN TO CONVEY A SEWER EASEMENT OVER A PORTION OF CERTAIN PARK LAND.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. Notwithstanding any general or special law to the contrary, but subject to paragraphs (a), (b) and (g) of section 16 of chapter 30B of the General Laws, the city of Malden, acting by and through its city council, may convey a sewer easement over a portion of a certain parcel of land located in said city to Malway Realty Associates Limited Partnership, a Massachusetts limited partnership, and to Stephen Weiner, as Trustee of Malway Realty Trust under a Declaration of Trust dated March 18, 1974, recorded with the Middlesex south district registry of deeds at book 12613, page 489 and registered with the Middlesex south registry district of the land court as document number 521352, as amended. The easement is shown as "Easement for Sewer Purposes, Approx. Area =600± S.F." which easement runs over park land which is shown as Lot A on a plan entitled "36 Broadway (Broadway Plaza) & 266 Maplewood Street (Maplewood Park), Easement Plan of Land Located in Malden, Massachusetts (Middlesex County), Prepared for Malden Redevelopment Authority, dated September 21, 2012, prepared by Meridian Associates, 500 Cummings Center, Beverly, Massachusetts 01915, a copy of which is to be attached to an Easement Agreement to be recorded in the Middlesex south district registry of deeds and registered with the Middlesex south registry district of the land court.

SECTION 2. In consideration for and as a condition of the conveyance authorized in section 1, Malway Realty Associates Limited Partnership as described in section 1 shall convey to the city of Malden an easement to be used for park purposes, the location of which easement is shown as "Easement for Ball Field Purposes, Approx. Area = 31,600 ± S.F." on the plan described in said section 1.

SECTION 3. This act shall take effect upon its passage.
