AN ACT AUTHORIZING THE WILKINSONVILLE WATER DISTRICT TO CONVEY A CERTAIN PARCEL OF LAND
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
SECTION 1. The board of water commissioners of the Wilkinsonville water district may convey to Atlas Box Company a certain parcel of land located in the town of Sutton; provided, however, that the district may reserve an easement over the parcel for access to maintain and install utilities and equipment to wells located on abutting parcels. The parcel is more particularly described as follows:
a certain parcel of land located southerly of Boston road and northeasterly of the Worcester-Providence turnpike in the town of Sutton, Worcester County, Massachusetts, and shown as “Parcel '2'” on a plan entitled “Parcel of Land in Sutton, Mass.”, dated September 30, 2008, prepared by Guerriere & Halnon, Inc., recorded with the Worcester District Registry of Deeds in Plan Book 872, Plan 90, hereinafter referred to as the plan, and bounded and described as follows:
Thence S 55° 05' 42" E a distance of 466.34 feet by land now or formerly of Woodburyville Heights Condominium Trust to a point at land now or formerly of Judson Lavallee Corp.;
Thence S 15° 59' 39" W a distance of 185.61 feet by land of said Judson Lavallee Corp. to a point at land now or formerly of B.N.T. Sand & Gravel Co., Inc.;
Thence N 65° 34' 44" W a distance of 137.32 feet to a point;
Thence N 39° 04' 49" W a distance of 201.98 feet to a point;
Thence S 57° 30' 58" W a distance of 107.46 feet to a point at Parcel “D” as shown on said plan. The last 3 courses being by land now or formerly of said B.N.T. Sand & Gravel Co., Inc.;
Thence Northerly by a curve to the left having a radius of 400.00 feet, an arc length of 296.39 feet by said Parcel “D” to the point of beginning.
The above-described Parcel contains an area of 75,441 square feet, more or less.
Subject to and with benefit of any easements, rights-of-way, restrictions, reservations or other limitations of record which may now be in force of applicable, without reimposing the same.
Being the same premises acquired for water supply protection under sections 15B, 39 and 41 of chapter 40 of the General Laws, by the board of water commissioners of the Wilkinsonville Water District, in an order of taking dated January 8, 2009, and recorded in the Worcester district registry of deeds in book 43660, page 233.
SECTION 2. The consideration for the conveyance authorized in section 1 shall be $22,000, which shall be used to protect the water supply of the Wilkinsonville water district.
SECTION 3. This act shall take effect upon its passage.
