AN ACT AUTHORIZING THE MASSACHUSETTS DEPARTMENT OF TRANSPORTATION TO ACQUIRE CERTAIN PARCELS OF LAND IN THE CITY OF FALL RIVER

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  The Massachusetts Department of Transportation may acquire by eminent domain, purchase or otherwise parcel 29-38, in the city of Fall River to be diverted from its present use for housing purposes to a highway use.  Parcel 29-38 is a parcel of land supposedly owned by the Fall River Housing Authority and  bounded and described as follows:
     Beginning at a point on the northerly line of the March 26, 1963 State highway alteration (Layout No. 5311) of Route 79, said point being N 0o36’04”E and 68.44 feet distant from station 7+77.71 of Auxiliary Baseline A of the June 26, 1962 State highway layout (Layout No. 5202):
     Thence running westerly by said northerly line of the March 26, 1963 State highway layout about 115 feet,
     Thence running southwesterly by said northerly line of the March 26, 1963 State highway layout about 57 feet;
     Thence running westerly by the northerly line the aforementioned June 26, 1962 State highway layout about 0.4 feet;
     Thence running northeasterly by the 1954 City layout of Broadway about 83 feet;
     Thence running easterly by the southeasterly line of the June 26, 1962 State highway layout about 7 feet;
     Thence running northeasterly by the southeasterly line of the June 26, 1962 State highway layout about 81 feet;
     Thence running southeasterly by northeasterly line of the March 26, 1963 State highway layout about 102 feet to the point of beginning.
     Parcel 29-38 contains an area of about 5,440 square feet.
     SECTION 2.  The Massachusetts Department of Transportation may acquire by eminent domain, purchase or otherwise parcel 29-27-C in the city of Fall River.  Such parcel shall be diverted from its present use as a buffer park to a highway use.  Parcel 29-27-C is a parcel of land supposedly owned by the city of Fall River located on the northerly side of Central street and  bounded and described as follows:
     Beginning at a point on the northeasterly side of Central Street, said point being N33˚02’02”E and 26.11 feet distant from station 19+81.22 of the 1941 Central Street Baseline of the 1941 City of Fall River layout:
     Thence running northwesterly by the northeasterly line of Central Street about 478 feet,
     Thence running northwesterly and northerly by the southeasterly line of Harbor Terrace about 31 feet;
     Thence running southerly and southeasterly about 30 feet;
     Thence running southeasterly a distance of about 475 feet to the point of beginning.
     Parcel 29-27-C contains an area of about 1,021 square feet.
     SECTION 3.  The parcels of land referenced in this act are shown on a plan entitled “Parcel No. 29-38 and 29-27-C Fall River Housing Authority Fall River MA 02720” prepared by Nitsch Engineering and dated 12/7/12. The plan is on file with the chief engineer of the highway division of the Massachusetts Department of Transportation.
