AN ACT AUTHORIZING THE TOWN OF LINCOLN TO GRANT A LICENSE FOR THE SALE OF ALCOHOLIC BEVERAGES TO BE DRUNK ON THE PREMISES.

      Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
      SECTION 1.  Notwithstanding sections 11 and 17 of chapter 138 of the General Laws or any other general or special law to the contrary, the licensing authority of the town of Lincoln may grant an additional license for the sale of all alcoholic beverages to be drunk on the premises pursuant to section 12 of said chapter 138 to Blazes LLC at a location to be determined by Blazes LLC and approved by the licensing authority. The license shall be subject to all of said chapter 138 except said section 17.
      Once issued, the licensing authority shall not approve the transfer of the license to any other location but it may grant the license to a new applicant at the same location if the applicant files with the licensing authority a letter from the department of revenue and a letter from the department of unemployment assistance indicating that the license is in good standing with those departments and that all applicable taxes, fees and contributions have been paid.
      If the license granted pursuant to this section is cancelled, revoked or no longer in use, it shall be returned physically, with all of the legal rights, privileges and restrictions pertaining thereto, to the licensing authority and the licensing authority may then grant the license to a new applicant at the same location under the same conditions as specified in this section.
      SECTION 2.  Notwithstanding sections 11 and 11A of chapter 138 of the General Laws as to the time and manner of voting on the question of granting the license authorized in section 1, this act shall be submitted for its acceptance to the qualified voters of the town of Lincoln at an annual or special town election in the form of the following question:
      “Shall an act passed by the General Court in the year 2016, entitled ‘An act authorizing the town of Lincoln to grant a license for the sale of all alcoholic beverages to be drunk on the premises’, be accepted?”
      Below the ballot question shall appear a fair and concise summary of the ballot question prepared by town counsel and approved by the board of selectmen.
      If a majority of the votes cast in answer to the question is in the affirmative, the town shall be taken to have authorized the granting of a license to sell all alcoholic beverages to be drunk on the premises to Blazes LLC.
      SECTION 3.  This act shall take effect upon its passage.
