AN ACT ESTABLISHING AN APPOINTED TOWN CLERK IN THE TOWN OF WEST BOYLSTON

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  Notwithstanding section 1B of chapter 41 of the General Laws, or any other general or special law to the contrary, there shall be an appointed town clerk in the town of West Boylston with all the powers and duties vested by law in the office of the town clerk. The town clerk shall be appointed and may be removed by the town administrator pursuant to this act and chapter 23 of the acts of 1995 and a vacancy in the office shall be filled in like manner.
     SECTION 2.  The first paragraph of section 2 of chapter 23 of the acts of 1995 is hereby amended by striking out clauses (d) to (i), inclusive, and inserting in place thereof the following 5 clauses:-
     (d)  municipal light board
     (e)  school committee
     (f)  housing authority
     (g)  planning board
     (h)  cemetery trustees.
     SECTION 3.  Section 6 of said chapter 23, as amended by section 2 of chapter 249 of the acts of 2008, is hereby further amended by inserting after the word “health”, in line 1, the following words:- , town clerk.
     SECTION 4.  As of the effective date of this act, the elected office of town clerk in the town of West Boylston shall be abolished; provided, however, that the incumbent town clerk as of the effective date shall hold the office and perform the duties of the office until the appointment to the office under this act is made by the town administrator.
     SECTION 5.  This act shall take effect upon its passage.
