AN ACT RELATIVE TO THE CONTRIBUTIONS OF CERTAIN EMPLOYEES IN THE TOWN OF KINGSTON

     Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
     SECTION 1.  Notwithstanding the definition of “employee” in section 2 of chapter 32B of the General Laws or any other general or special law to the contrary, part-time elected officials of the town of Kingston who receive stipends by vote of the town at an annual or special town meeting pursuant to section 108 of chapter 41 of the General Laws shall not be eligible for participation in the town’s contributory insurance plan, hereinafter referred to as the plan.
     SECTION 2.  (a) Notwithstanding section 1, a part-time elected official of the town of Kingston who was elected before the effective date of this act, whether or not presently serving, if eligible and vested on the effective date of this act to participate in the plan upon retirement, or as presently retired, shall continue to be eligible and vested to participate upon retirement, or as presently retired.
     (b)  Notwithstanding section 1, a part-time elected official of the town of Kingston who was elected before the effective date of this act who participates or elects to participate while still holding that office shall continue to be eligible to participate in the plan until the end of that official’s current term or any successive contiguous terms.
     (c)  Notwithstanding section 1, a part-time elected official of the town of Kingston who is elected after the effective date of this act who receives a stipend may participate in the plan provided that the official pays 100 per cent in the plan, plus any administrative cost for the plan as may be imposed by the board of selectmen.
     SECTION 3.  This act shall take effect upon its passage.
