AN ACT ESTABLISHING A REVOLVING FUND IN THE TOWN OF WESTBOROUGH.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:

SECTION 1. Notwithstanding section 53 of chapter 44 of the General Laws or any other general or special law to the contrary, any income received from the purchase and sale of products by a vocational-technical program conducted and operated by the public schools in the town of Westborough and any gifts, grant funds or donations in relation to the operation of the program shall be deposited in a Vocational-Technical Program Fund which shall be established by the school committee in a banking institution in the commonwealth. Expenditures may be made from the fund by the school committee for the purposes of the program area without further appropriation; provided, however, that no money in the fund shall be used to pay the salary of a school employee whose work involves the operation of or instruction in the program. An annual report, which shall include projects undertaken, expenditures made and income received by the fund, shall be submitted to the school committee not later than December 31 and the school committee shall vote on whether to accept the report.

SECTION 2. Section 1 shall be limited to the conduct and operation of a program which: (i) constitutes an in-district program within the meaning of regulations promulgated by the board of education pursuant to chapters 69 and 71B of the General Laws; (ii) serves the needs of students who are at least 18 years of age but not more than 22 years of age; and (iii) has both an educational and a vocational focus.
