AN ACT EXPANDING THE POWERS OF THE BAKER HILL ROAD DISTRICT IN THE TOWN OF LANESBOROUGH TO INCLUDE ECONOMIC DEVELOPMENT EFFORTS.
Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same as follows:
SECTION 1. Section 2 of chapter 41 of the acts of 1989 is hereby amended by inserting after the word “way”, in line 4, the following words:- and, without limiting its authority, to: retain or recruit business; promote economic development; design, engineer, construct, maintain or operate buildings, facilities, streetscapes or infrastructure to further economic development and public purposes; lease, own, acquire or option real property; supplement maintenance, security or sanitation; plan and design services; undertake planning, feasibility and market analyses; develop common marketing and promotional activities; and support public art and human and environmental services as related to the enhancement of the district.
SECTION 2. Said section 2 of said chapter 41 is hereby further amended by inserting after the word “District”, in line 10, the following words:- ,
(a½) to acquire and hold real property within the District by purchase, gift, devise or tax title foreclosure for nonpayment of taxes assessed pursuant to this act; provided, however, that if the District acquires title to real property through tax title foreclosure, the District shall enter into an agreement with the town to make payments in lieu of taxes to the town for the unpaid taxes due to the town and to purchase or lease equipment, materials and services necessary or appropriate for the purposes of the District to the same extent and subject to the same limitations that apply to towns in the commonwealth.
SECTION 3. Said section 2 of said chapter 41 is hereby further amended by striking out, in lines 17 and 18, the words “, but for none other”.
SECTION 4. Section 7 of said chapter 41 is hereby amended by striking out, in lines 6 and 7, the words “paying the cost of acquisition of and maintenance of the road as described in this act” and inserting in place thereof the following words:- carrying out the purposes of this act.
SECTION 5. This act shall take effect upon its passage.
