AN ACT PROVIDING FOR THE EXCHANGE OF CERTAIN PARK LAND IN THE TOWN OF ROCKLAND

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  The town of Rockland may transfer the care, custody, management and control of a certain parcel of park land currently held by the board of park commissioners to the school committee for the siting of a new Memorial school building.  The parcel of land is shown on a plan of land entitled “F2 - Article 97 Land Transfer: Proposed Memorial Taking”, dated March 13, 2019, comprising 7.49 acres, more or less, and being a portion of lot 1B on a plan of land entitled “Plan of Land, 52 Mackinlay Way, Rockland, MA”, dated August 24, 2012, which is on file with the town clerk.

SECTION 2.  (a) In consideration for the transfer authorized in section 1, the town of Rockland shall transfer the care, custody, management and control of 2 parcels of land currently held by the school committee and comprising 11.34 acres, more or less, to the board of park commissioners and such land shall be held for public park and open space purposes.  The parcels of land are described as follows: (i) a certain parcel of land as shown on a plan of land entitled “F1 - Article 97 Land Transfer: Proposed Memorial Giving”, dated March 13, 2019, consisting of 5.54 acres, more or less, which is currently used as the site of the existing Memorial school and adjoining parking area; and (ii) a certain parcel of land as shown on a plan of land entitled “F3 - Article 97 Land Transfer: Proposed Jefferson Giving”, dated March 13, 2019, consisting of 5.8 acres, more or less, and also shown on the town of Rockland assessors’ maps as parcel 52-006, which parcel is currently being used as the site of the existing Jefferson school and adjoining access and parking areas.

(b)  The town shall provide ball fields and other outdoor recreational resources on these parcels within 2 years after the completion of the Memorial school. If the construction of the Memorial school is not commenced within 3 years after the land transfers authorized in this act, the parcel described in section 1 shall revert to the care, custody, management and control of the board of park commissioners for park purposes, and the town shall restore the parcel to ball fields and other outdoor recreational resources.

SECTION 3.  This act shall take effect upon its passage.
