AN ACT AUTHORIZING THE CITY OF FITCHBURG TO EMPLOY KEVIN D. ROY AS FIRE CHIEF BEYOND THE RETIREMENT AGE

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Notwithstanding any general or special law to the contrary, Kevin D. Roy may be appointed and may continue to serve in the position of the fire chief of the fire department of the city of Fitchburg until June 30, 2020, the date of his retirement or the date he is relieved of his duties by the mayor, whichever occurs first; provided, however, that he is mentally and physically capable of performing the duties of the office. The city of Fitchburg, at its own expense, may require Kevin D. Roy to be examined by an impartial physician designated by the city to determine his mental and physical capability. No further deductions shall be made from the regular compensation of Kevin D. Roy under chapter 32 of the General Laws for any service subsequent to January 31, 2020 and upon retirement he shall receive a superannuation retirement allowance equal to that which he would have been entitled had he retired on January 31, 2020.

SECTION 2.  This act shall take effect upon its passage.
