AN ACT AUTHORIZING THE TOWN OF HADLEY TO CONVEY A CONSERVATION RESTRICTION ON CERTAIN PARCELS OF LAND.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  (a) Notwithstanding any general or special law to the contrary, the board of selectmen of the town of Hadley, acting as the board of water commissioners pursuant to chapter 714 of the acts of 1971, may convey to Kestrel Land Trust, a nonprofit charitable conservation trust established under the laws of the commonwealth, for no or nominal consideration, a perpetual conservation restriction pursuant to section 31 to 33, inclusive, of chapter 184 of the General Laws on 3 parcels of land owned by the town for water supply purposes and as identified in subsection (b). The conservation restriction shall be for: (i) the preservation of the water supply; (ii) fish and wildlife conservation; (iii) native habitat protection; (iv) forest management; (v) outdoor recreation compatible with conservation; and (vi) any other purpose consistent with Article 97 of the Amendments to the Constitution of the Commonwealth. The conveyance of the conservation restriction shall be on such terms and conditions as the board of selectmen, acting as the board of water commissioners, shall deem appropriate.

(b)  The 3 parcels of town owned land to be restricted pursuant to subsection (a) are located southerly of Bay road and identified on the town of Hadley board of assessors’ maps as: (i) map 8, parcel 9, consisting of 42.56 acres, more or less; (ii) map 8, parcel 46, consisting of 78 acres, more or less; and (iii) map 8, parcel 48, consisting of 215 acres, more or less.

SECTION 2.  This act shall take effect upon its passage.
