AN ACT AUTHORIZING THE TOWN OF HARVARD TO CONVEY AN EASEMENT OVER A CERTAIN PARCEL OF CONSERVATION LAND

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Notwithstanding any general or special law to the contrary, but subject to paragraphs (a), (b) and (g) of section 16 of said chapter 30B of the General Laws, the town of Harvard, acting by and through its conservation commission, may convey an easement to Carlson Orchards, Inc. for a zone 1 well protection easement over a portion of the Dunlap conservation land site for the benefit of Carlson Orchards, Inc.’s abutting land. The Dunlap conservation land site is located on the southerly side of Old Littleton road and is identified on the town assessors’ maps as map 18, parcel 70.  The land is described as parcel two in a deed recorded with the Worcester district registry of deeds in book 43843, page 377 and shown as parcel A on the plan recorded with said registry of deeds in plan book 180, page 128. The portion of parcel of land to be used for the easement contains approximately 36,265 square feet and is partially located in the department of environmental protection drinking water program approved zone 1 of the well and is further described and shown on the unrecorded plan entitled “Exhibit D – Public Water Supply Zone 1 Area in Harvard, Mass.”, dated August 2019, a copy of which plan is on file in the office of the town clerk.

SECTION 2.  This act shall take effect upon its passage.
