AN ACT AUTHORIZING THE TOWN OF LITTLETON TO USE CERTAIN LAND FOR CONSTRUCTION OF A WATER TREATMENT FACILITY WITHOUT ARTICLE 97 RESTRICTIONS ON SUCH USE.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  (a) Notwithstanding any general or special law to the contrary, the board of water commissioners of the town of Littleton may use a certain parcel of land consisting of 2.695 acres, more or less, which was taken by the town for water supply protection purposes, for the construction of a water treatment facility and associated infrastructure. The parcel, which is identified on the town’s assessors’ maps as parcel U41-38-0, is a portion of the property described in an order of taking recorded in the Middlesex southern district registry of deeds in book 19902, page 89 and is shown on a plan of land recorded in the Middlesex southern district registry of deeds in plan book 2020, page 176.

(b)  To mitigate the change of use of the parcel as authorized in subsection (a) and to ensure a no-net-loss of lands protected for conservation purposes, the town of Littleton shall record a conservation restriction pursuant to section 32 of chapter 184 of the General Laws on the parcel of land located at 74 Whitcomb avenue, which is identified on the town’s assessors’ maps as parcel U40-15-0, consisting of 2.75 acres, more or less. The parcel is shown on a plan of land recorded in the Middlesex southern district registry of deeds in plan book 2020, page 176. The restriction shall require that the parcel described in this section to be preserved in a natural condition and used for water supply protection purposes.

SECTION 2.  This act shall take effect upon its passage.
