AN ACT AUTHORIZING THE TOWN OF EGREMONT TO UTILIZE A PORTION OF FRENCH PARK TO CONSTRUCT A BROADBAND HEADEND.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

(a)  The town of Egremont, acting through its board of selectmen, as trustees under the tenth paragraph of the will of Mabel R. French Champion, may utilize a portion of French park shown on the town assessors' map 9, parcel 982, approximately 180 feet northerly of the southeast corner of the town’s tax map 9, parcel 982, at latitude 42.190154 and longitude -73.439622, for the purposes of constructing a broadband headend, as well as any easements or rights of way necessary to maintain such facilities.

(b)  As a condition of the authorization granted in this act and to ensure no net loss of land under Article 97 of the Amendments to the Constitution of the Commonwealth, the town of Egremont shall expand the trail network in the southeast section of French park to benefit public passive recreation access.
