AN ACT FURTHER REGULATING THE MEMBERSHIP OF THE BOARD OF TRUSTEES OF THE WOBURN PUBLIC LIBRARY.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  The second sentence of section 2 of chapter 273 of the acts of 1885 is hereby amended by striking out the words “, not exceeding three hundred thousand dollars in value,”.

SECTION 2.  Said chapter 273, as amended by chapter 261 of the acts of 1915, is hereby further amended by striking out sections 4 to 6, inclusive, and inserting in place thereof the following 2 sections:-

SECTION 4.  Subject to confirmation by the city council, the mayor of the city of Woburn may appoint no more than 9 members of the board of trustees of the Woburn Public Library, who shall be Woburn residents, in such a manner that 1/3 thereof shall serve for a term of 1 year, 1/3 of the members  shall serve for terms of 2 years and 1/3 of the members shall serve for terms of 3 years, and thereafter 1/3 shall be appointed for a term of 3 years. Vacancies in the board of trustees shall be filled by the mayor subject to confirmation of the city council. The appointed members of the board of trustees, shall constitute the board of trustees of the Woburn Public Library with all the powers appurtenant to trustees of a free public library, except as otherwise herein provided. The board of trustees shall annually elect from among its members a president and a clerk. The mayor shall have the sole power of appointment of the library director. The city treasurer shall act as treasurer for the corporation without providing additional bond.

SECTION 5.  In the month of January, the trustees shall provide to the mayor and city council an annual report of their proceedings in the previous year, together with a statement of the condition of the library, its property and a summary of the programs, projects, activities and events offered to the community. The trustees shall provide to the mayor and city council an annual audit of all trust funds held, including details of receipts and expenditures.

SECTION 3.  The terms of the 6 current members of the board of trustees who were appointed as “lifetime trustees” or “lifetime members”, so called, and whose appointments occurred more than 3 years ago, shall cease immediately upon the passage of this act.

SECTION 4.  This act shall take effect upon its passage.
