AN ACT RELATIVE TO A CERTAIN PARCEL OF LAND IN THE TOWN OF TOWNSEND

Whereas, The deferred operation of this act would tend to defeat its purpose, which is to authorize forthwith the department of fish and game to void a deed over certain property it previously acquired by gift, therefore it is hereby declared to be an emergency law, necessary for the immediate preservation of the public convenience.

Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows:

SECTION 1.  Notwithstanding any general or special law to the contrary, the commonwealth, acting by and through the department of fish and game, may void the deed by which the department acquired, for conservation purposes, a certain parcel of land located in the town of Townsend as a gift from the grantor, Mary A. Ballarino, which deed is recorded with the Middlesex Southern district registry of deeds in book 75813, page 486; provided, however, that the department shall not void the deed unless Mary A. Ballarino agrees to convey the parcel to the department for consideration of $1 once the deed is voided. Upon the land being conveyed to the department pursuant to this section, the department shall hold the parcel for conservation purposes.

SECTION 2.  The land to be conveyed pursuant to section 1 is shown on a plan of land entitled “Plan of Land in Townsend, Mass. Prepared for Robert C. Ballarino”, dated October 2007, prepared by David E. Ross Associates, Inc. and recorded in with the Middlesex Southern district registry of deeds in book 2020, page 717.
